1. Acceptance of Terms

By accessing, browsing, registering for an account, or listing properties on PropertyCircle (accessible via propertycorner.ng and propertycircle.vercel.app), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our Privacy Policy.

If you do not agree to these terms, you must discontinue the use of our services immediately.

2. Nature of Platform & Marketplace Role

PropertyCircle operates as a digital technology marketplace designed to facilitate connections between prospective property seekers (buyers, tenants, and investors) and verified real estate professionals, including estate agents, property developers, and direct property owners.

3. Publisher, Agent & Developer Obligations

Any individual or corporate entity registering as an Agent, Owner, or Developer represents and warrants that:

• Legal Authority & Mandate: You hold genuine, verifiable authority, power of attorney, or written marketing mandates from the lawful titleholder to market the property.
• Accuracy of Data: All property details, dimensions (sqm), bedroom counts, pricing, and title document representations (e.g., Certificate of Occupancy, Governor’s Consent, Gazette) are completely truthful and current.
• Regulatory Compliance: Where applicable (such as in Lagos State), agents and developers must adhere to the rules and registration standards set by the Lagos State Real Estate Regulatory Authority (LASRETRAD) and applicable state real estate laws.
• Authentic Imagery: All uploaded photos, floor plans, and video tours are genuine representations of the listed property and do not infringe on third-party intellectual property or copyright.

4. Prohibited Conduct & Content Moderation

PropertyCircle enforces a strict zero-tolerance policy against fraudulent activity. Users agree NOT to:

• Post misleading, non-existent, or duplicate "ghost" listings.
• Charge unlawful, unverified "advance inspection fees" prior to physical viewings.
• Upload forged, altered, or fraudulent title documentation.
• Harvest or scrape contact information of agents or seekers for unsolicited marketing.
• Impersonate another agent, corporate entity, or platform administrator.

PropertyCircle reserves the absolute right to suspend, terminate, or remove any listing or account that violates these standards, and report fraudulent behavior to law enforcement authorities.

5. Intellectual Property & Content License

By submitting photos, project brochures, descriptions, and media to PropertyCircle, you grant PropertyCircle a non-exclusive, worldwide, royalty-free license to display, optimize, market, and distribute the content across our website, search index integrations, newsletters, and social media channels for the purpose of promoting your listing.

6. Limitation of Liability

To the maximum extent permitted by the laws of the Federal Republic of Nigeria, PropertyCircle, its directors, officers, employees, and affiliates shall not be liable for any indirect, consequential, punitive, or financial damages arising from:

• Inaccuracies or omissions in user-uploaded property listings.
• Direct transactions, contract breaches, or disputes between buyers, agents, and developers.
• Failure by any party to conduct adequate physical inspections or formal title searches at relevant State Land Registries.

7. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute, claim, or controversy arising out of or relating to this platform shall first be submitted to good-faith mediation, and if unresolved, to the competent courts of jurisdiction in Lagos State, Nigeria.
